As we head into the fourth quarter, it’s clear that the real estate market of 2010 is shaping up to be better than that of 2009, though only marginally so. Around the country, brokers in the high-end real estate business are reporting modest increases in activity. Brokers at the Christie’s Great Estates conference this month in Toronto reported higher sales figures this year. Most, however, are also reporting price declines of about 30% (up to 40% for big properties) from the highs reached in 2006.

Real Estate Tax to Go Into Effect in 2013

A real estate tax was recently approved along with the passing of the health care reform bill.  Beginning January 1, 2013, if a primary residence is sold for more than $250,000 profit, there will be a 3.8% tax applied to the capital gains in excess of $250,000.  If a primary residence is sold by a couple, the 3.8% tax will be applied to the capital gains above $500,000.  The tax is limited to those with a gross income over $200,000 per year or $250,000 for couples who file jointly.

All capital gains are subject to the 3.8% real estate tax if the residence is not a primary residence.
